US LLC Formation for Non-Resident Amazon Sellers

You do not strictly need a US LLC to sell on Amazon.com; Amazon accepts sellers from many countries, including Turkey, Germany and the UAE. Many international sellers still form one for US banking and payment rails, an EIN with Seller Central set up under the company, and the buyer trust a US business identity brings. We handle it all remotely, with no SSN and no US visit required.

How the Formation Works for a Non-Resident Seller

Everything runs remotely, from state choice to the Seller Central account; no visa, SSN or US visit is required. At each step you know exactly what we need from you.

1

Name Check & Structure Decision

We confirm LLC versus C-Corp and settle the state: Wyoming or New Mexico for most first-time sellers, Delaware when investors are realistic, Florida on request. We check name availability and arrange the in-state registered agent every state requires. You send a passport copy and a short description of what you sell.

2

State Filing & Company Documents

We file the Articles of Organization with the Secretary of State and prepare the operating agreement and the bank-account authorisation document you will need later. Once the filing clears, your formation certificate comes through.

3

EIN Without an SSN

The EIN is the federal tax ID that Amazon, banks and payment providers ask for. Non-residents without an SSN or ITIN apply with IRS Form SS-4; this route runs by fax or mail, and standard IRS processing can take several weeks.

4

Bank Account, Payments & Seller Central

With the documents and EIN in hand, we support the US business bank account application, set up Stripe or PayPal for your own store, and register the Amazon Seller Central account under the LLC, including identity verification and the tax interview. Approval decisions always rest with the bank, the provider or Amazon.

Company Structure Comparison

LLC or C-Corp for an Amazon Seller?

For a single owner or a small partnership selling physical products, an LLC is usually the simpler structure; a C-Corp is the standard choice when outside investors are on the roadmap. Tax rows are topics for an advisor, not advice.

FAQ

Frequently Asked Questions About a US LLC for Amazon Sellers

The questions non-resident sellers ask most about state choice, the EIN, bank accounts and ongoing US obligations.

Do I need a US LLC to sell on Amazon.com from Turkey, Germany or the UAE?
No. Amazon accepts seller registrations from residents and companies of many countries, including Turkey, Germany and the UAE, and you can register with your local company. A US LLC is a choice you make for US banking, payment providers such as Stripe, liability separation and a US business identity.
Do I need an SSN or ITIN to form an LLC and get an EIN?
No. The state does not ask for either when filing the LLC. For the EIN, the IRS accepts Form SS-4 from responsible parties without an SSN or ITIN; the application is submitted by fax or mail rather than through the online tool, which is why it takes longer.
Do I have to travel to the United States?
No. Formation, the EIN, the operating agreement and the Amazon registration are all handled remotely with electronic signatures and a passport copy. Some banks may require a video call; none of our standard steps require a visit.
Which state is best for an Amazon seller?
Amazon accepts LLCs from any state. For most first-time sellers Wyoming or New Mexico keep annual paperwork lightest; Delaware is the usual choice when investors or a later C-Corp are planned. Each state's official site lists its current fees and annual duties.
Can a non-resident open a US business bank account remotely?
Often, yes, through banks and fintech providers that accept non-resident-owned LLCs with an EIN and formation documents. Approval is the provider's decision and depends on your country, industry and documentation. We support the application; we do not guarantee approval.
Can Apex Global World also open my Amazon Seller Central account?
Yes. Seller Central account setup is included in the Standard and Advanced formation packages and is also available as a standalone Amazon service. We handle registration, identity verification and the tax interview walkthrough; Amazon makes the final approval decision.
What happens after formation each year?
Expect a state annual report or annual tax depending on the state, registered agent renewal, Form 5472 with a pro-forma 1120 for a foreign-owned single-member LLC, and any income tax filings your US or home-country advisor determines. We flag deadlines and refer you to a tax professional for the returns.
Who collects sales tax on my Amazon sales?
For sales made through Amazon.com, Amazon calculates, collects and remits sales tax in the states with marketplace facilitator laws, which now covers every state with a sales tax. Sales through your own Shopify store are different: you are the seller of record and may have registration duties where you cross economic nexus thresholds.
Does FinCEN beneficial ownership (BOI) reporting apply to my LLC?
FinCEN's BOI reporting applied to US-formed LLCs when it launched in 2024. In March 2025 an interim final rule removed the requirement for companies formed in the United States and kept it for foreign-formed companies registered in the US. Rules here have changed several times, so check fincen.gov/boi before assuming you have no filing.
What if my Amazon account gets suspended later?
Account suspensions are handled as a separate service with a written plan of action tailored to the suspension type (verification, performance or related-account). Details are on the Amazon services pricing page. Reinstatement is Amazon's decision; no provider can guarantee it.
